Terms of Use

1. General

  1. This Terms of Use page is an electronic record under the Information Technology Act, 2000 and the rules framed under it (including updates that apply to electronic records). It is produced through a computer system and does not require a handwritten or digital signature.
  2. This document is made available to meet the disclosure requirements under Rule 3(1) of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, including publication of platform rules, the privacy policy, and these Terms for access to or use of the Doloans website.
  3. The domain https://www.doloans.in (the “Website”) is owned and operated by Doloans (the “Company”). References to the Company, unless the context suggests otherwise, include its representatives, administrators, employees, directors, officers, agents, successors, and permitted assigns.
  4. For interpretation of these Terms: (i) “You” and “User” refer to any person or entity accessing or using the Website or its services who is legally capable of entering into a binding contract under the Indian Contract Act, 1872; (ii) “We”, “Us”, and “Our” refer to the Website and/or the Company, as applicable; (iii) “Party” and “Parties” refer to the User and the Company individually and together, depending on the context.
  5. Section titles and headings are provided only to make these Terms easier to read. They do not affect interpretation and do not carry legal or contractual weight.
  6. Your access and use of the Website is governed by these Terms and our Privacy Policy (the “Policy”). We may revise either document from time to time at our discretion. By visiting the Website and/or using any service on it, you confirm your acceptance of these Terms and the Policy. You also acknowledge that the Terms and the Policy operate together, and expiry or termination of one will generally result in expiry or termination of the other, except where specific provisions state otherwise.
  7. You agree that these Terms together with the Policy form a legally enforceable agreement between you and the Company. Any additional rules, guidelines, or service-specific terms displayed on the Website for a particular feature are treated as incorporated into these Terms and apply to the relevant service.
  8. The Company may update these Terms by publishing the revised version on the Website. You are responsible for reviewing them periodically. While you comply with these Terms, you receive a personal, limited, revocable, non-exclusive, and non-transferable permission to access and use the Website.

The Services

Doloans provides a digital platform to help users explore and submit enquiries for financial products. Our services include:

  • Assisting users in selecting a suitable product and connecting them with the relevant bank, NBFC, or partner, until the request is taken forward and processed.
  • Helping users understand documentation and common process requirements, and offering guidance on related topics such as insurance or taxation where relevant (without acting as a regulated tax or legal advisor).
  • Providing ongoing assistance via assigned support or relationship help where available, subject to operational availability and service scope.

2. Eligibility

By using the Website, you confirm that you are competent to enter into a binding agreement under the Indian Contract Act, 1872 and that you have authority to accept these Terms. If you are not legally competent to contract, or are otherwise restricted by applicable law from using the Website, you must not access or use it.

3. Term

These Terms remain effective and binding between the Parties for as long as:

  1. You continue to access or use the Website; or
  2. Any transaction or engagement initiated through the Website continues until it is concluded to the satisfaction of both Parties,

whichever lasts longer. Certain sections by their nature are intended to survive termination or expiry, including provisions relating to indemnity, limitation of liability, intellectual property, dispute resolution, and similar obligations.

4. Termination

The Company may restrict, suspend, or terminate your access to all or part of the Website or services at any time, with or without notice, where permitted by law. You agree that you remain bound by these Terms for obligations that survive termination, and you do not have a right to terminate these Terms except as permitted under applicable law.

5. Online Service Platform

The Website operates as an online service platform that provides information, guidance, and enquiry pathways for financial products and related services. We may also display informational content that helps users make decisions, subject to the disclaimers in these Terms.

6. Communication

By using the Website and sharing your contact details, you consent (subject to the Policy and applicable law) to receive calls, auto-dialed or pre-recorded calls, emails, messages, and SMS from the Company and/or its partners for service fulfilment, updates, and marketing.

If you want to stop promotional communications, you may email support@darkcyan-salamander-401600.hostingersite.com with the subject line Stop marketing. We may take up to seven (7) business days to process the request. Service-related communications about an enquiry or product you requested may still be sent where necessary to complete or support that request.

Any personal information you provide is handled according to the Policy.

7. Charges

Browsing the Website is currently free. If any paid service is introduced, or if a service is offered for a fee, we will disclose the applicable charges at the time you attempt to use that feature. The Company may modify the pricing model from time to time; any such change becomes effective when notified on the Website, unless stated otherwise.

8. Mode of Payment

Where payments are enabled, available options may include:

  1. Domestic or international credit cards (Visa, MasterCard, Amex networks where supported);
  2. Debit cards (Visa/MasterCard where supported);
  3. Netbanking/direct debit from select banks (options shown during checkout);
  4. UPI and/or electronic wallets via authorized payment gateways/aggregators.

For card payments, you may need to provide card details such as the 16-digit number, expiry date, and CVV, and you may need to complete additional authentication (such as Verified by Visa or MasterCard SecureCode) as required by the issuer. Your statement may reflect a charge to the relevant merchant/service descriptor associated with the transaction. Orders or requests are processed after successful authorization and receipt of funds through the payment network.

Payments may be handled through third-party payment gateways/payment aggregators. When you place an order or make a payment on the Website (or where supported, over the phone with assistance), you agree to the payment terms and policies displayed at checkout or referenced for that service.

9. Security

Payment transactions (where available) are routed through secure systems. Information entered during a transaction is encrypted by the payment service provider to reduce risk of unintended disclosure. The Company does not receive or store full card details; such information is provided directly to the authorized payment gateway/payment aggregator in accordance with applicable compliance requirements.

10. User Obligations

You acknowledge that your access to the Website is limited to permitted use and you agree that you will not:

  1. Copy, modify, distribute, publish, sell, transmit, reverse engineer, or create derivative works from Website content or software without prior written permission. Bulk reproduction (commercial or non-commercial) and unauthorized data modification are prohibited.
  2. Access (or attempt to access) the Website by methods other than the provided interface. Automated scraping or monitoring using bots, spiders, deep-links, or similar methods that circumvent navigation or presentation may lead to suspension or termination. You understand that you may encounter content you find objectionable; the Company disclaims liability for third-party content and does not guarantee ownership of products/services displayed, which may belong to third parties.
  3. Where posting/uploading is allowed, ensure that submissions are lawful and not offensive. Content that violates laws or these Terms may be removed without notice and your access may be revoked.
  4. Engage in prohibited conduct including, but not limited to: harassment; interference with Website systems; impersonation; posting unlawful, harmful, obscene, defamatory, hateful, privacy-invasive, or misleading content; encouraging gambling or money laundering; uploading malware; infringing IP; probing security; collecting data about other users; violating laws or codes of conduct; threatening national security or public order; offering prohibited or restricted items; spamming or unsolicited outreach; or using Website data to harass or solicit others without written consent. The Company may share relevant information with lawful authorities where required for investigation or compliance.
  5. You are responsible for activity on your account. If you share access, OTPs, or allow another person to transact using your account, you remain responsible for resulting actions and transactions.
  6. You consent to receive updates (bug fixes, patches, new versions, and enhancements) necessary for service delivery, and continued use after updates indicates acceptance.
  7. You understand that availability and eligibility for products, services, and rewards may vary by location and user profile. The Company may determine availability and eligibility at its discretion.
  8. Notify the Company promptly to block access and change passcodes if your device is lost or stolen.
  9. Use the Website only for legitimate purposes and not for fraud, unlawful cashback schemes, money laundering, terrorist financing, illicit payments, or any activity prohibited by law or unethical.
  10. Avoid prohibited transactions and listings including: services that expose the Company or payment partners to reputational risk or chargeback/fraud losses; fake government IDs or documents; and any product/service not compliant with applicable laws (India or otherwise).

11. Violation of User Obligations

  1. If the Company believes you have breached these Terms, user obligations, the Policy, or any related consented agreement, it may suspend access or delete your account without prior notice. You may contact support for review where applicable.
  2. If suspicious or unusual activity is detected, the Company may take actions including: requiring repayment of benefits received through misuse; recovering unwarranted gateway/bank charges caused by fraudulent activity; applying a penalty (up to 3% of the transacted amount, which may increase based on severity); and temporarily or permanently suspending access to services.

12. Suspension of User Access and Activity

In addition to other legal remedies, the Company may limit or suspend access immediately (temporarily or indefinitely) or terminate membership without notice where permitted by law, including if:

  1. You breach these Terms or the Policy;
  2. You provide inaccurate, incomplete, or incorrect information;
  3. Your actions may cause harm, damage, or loss to other users or the Company/Website.

13. Indemnity and Limitations

You agree to defend, indemnify, and hold harmless the Company and the Website, including employees, directors, officers, agents, successors, and assigns, against claims, liabilities, damages, losses, costs, and expenses (including reasonable attorney fees) arising from your acts or omissions, breach of these Terms, violation of law, infringement of intellectual property, defamation, privacy violations, statutory dues, or other third-party rights.

To the maximum extent permitted by law, the Company/Website is not liable for special, incidental, indirect, consequential, or punitive damages (including loss of data, profits, or use) arising from or related to your access or use of the Website or services, whether foreseeable or not and regardless of the theory of liability.

These limitations apply to the fullest extent allowed by law. If a change in law would impose liability in a manner inconsistent with these Terms, the Parties agree that these Terms and the Policy may terminate as close as legally permissible prior to such change taking effect. This section survives termination.

14. Intellectual Property Rights

Unless expressly agreed in writing, nothing here grants you rights to use Doloans trade names, trademarks, service marks, logos, domain names, designs, graphics, or other brand features except as permitted by these Terms. All such intellectual property is owned by the Company.

You must not use our intellectual property in a way that confuses users, suggests endorsement, or harms the Company’s reputation.

Products or services displayed from third parties remain the intellectual property of their respective owners. The Company provides a platform for discovery and enquiries and does not claim ownership over third-party content. Any unauthorized reproduction may expose you to claims by the relevant rights holders. This section survives termination.

15. Disclaimer of Warranties and Liabilities

  1. Except where expressly stated, services and content are provided on an “as is” basis without warranties of any kind.
  2. The Company makes no implied warranties including merchantability or fitness for a particular purpose.
  3. You use the Website at your own risk and should apply your best judgment before acting on information or selecting products/services.
  4. The Company is not responsible for errors/omissions (its own or third-party) or for damages resulting from use or misuse of services.
  5. We do not guarantee uninterrupted operation or error-free services, and the Website may contain harmful components despite reasonable safeguards. You accept associated risks.
  6. This section survives termination.

16. Submissions

If you share suggestions, ideas, feedback, or other content with Doloans, you grant the Company a royalty-free, perpetual, irrevocable, non-exclusive license to use, reproduce, publish, distribute, transmit, display, adapt, and create derivative works from that content worldwide, in any media now known or later developed, without additional approval or compensation.

You represent that you own or control the rights to your submissions and that they do not infringe third-party rights. If a third party brings a claim against the Company relating to your content, you agree to indemnify the Company. The Company may defend such claims and recover costs from you.

17. Dispute Resolution and Jurisdiction

Any dispute relating to the formation, interpretation, or performance of these Terms will follow a two-step alternate dispute resolution process:

  1. Mediation: The Parties will first attempt an amicable resolution. If not resolved within 30 days of a written notice of dispute, the matter proceeds to arbitration.
  2. Arbitration: The dispute will be referred to a sole arbitrator appointed by the Company. Proceedings will be in English and the seat of arbitration will be Delhi, India. Each Party bears its own costs unless the arbitrator decides otherwise. The arbitral award will be final and binding.

These Terms and the Policy are governed by Indian law, and courts at Delhi will have exclusive jurisdiction over disputes, subject to the arbitration process above. This section survives termination.

18. Notices

Any grievance or dispute notice should be provided in writing and may be sent to the Company’s registered/official address via Registered Post Acknowledgement Due or Speed Post Acknowledgement Due, or via email where the Website provides a designated contact.

19. Miscellaneous Provisions

  1. Entire Agreement: These Terms together with the Policy are the complete agreement between the Parties and supersede prior communications and understandings relating to the subject.
  2. Waiver: Failure to enforce any provision at any time does not waive the right to enforce it later. A waiver of one breach does not waive other breaches.
  3. Severability: If any provision is held invalid or unenforceable, the remaining provisions remain effective. The Terms will be adjusted only to the minimum extent required to make them enforceable while preserving the Parties’ intent as far as legally possible.
